Terms and Conditions

These terms explain the basis on which BM Funeral Service provides funeral and deceased-care services. We have kept them as clear and straightforward as possible. Nothing in these terms affects your statutory rights as a consumer.

1. Who we are

BM Funeral Service is a trading name of BM Ambulance Group Limited. Our funeral service operates from The Granary, Leacon Farm, Leacon Lane, Charing, Kent, TN27 0EN.

2. Our services

BM Funeral Service provides services including direct cremation, dignified transportation of deceased persons, refrigerated mortuary care and specialist bariatric deceased care.

The services we agree to provide in an individual case will be confirmed with you. Some services depend on circumstances outside our control, including the release of the person who has died, completion of medical or legal documentation, crematorium availability, access to premises and any involvement of a coroner or other authority.

3. Direct cremation

A direct cremation is a cremation without a traditional attended funeral service at the crematorium.

Our Local Direct Cremation is £1,199 and includes collection within 25 miles of our Charing base. Our Extended Area Direct Cremation is £1,499 for collections over 25 miles and up to 50 miles.

Collections beyond 50 miles may be possible by prior agreement. Where agreed, mileage beyond the 50-mile radius is charged at £2.00 per additional mile.

Full details of what is included and any applicable additional charges are set out on our Prices page. We will tell you about additional charges that apply to your arrangements before you agree to them wherever they can reasonably be identified in advance.

4. Payment

Payment for direct cremation is required in full before the cremation arrangements proceed.

Where additional services or costs are required, these will be explained and agreed with you. We will not deliberately add unavoidable charges later simply to make an advertised price appear lower.

5. Information you give us

We rely on families and other people instructing us to provide accurate information. This may include the identity and location of the person who has died, contact details, documentation, access information and any circumstances relevant to safe transportation or care.

For bariatric deceased care or a complex removal, we may require estimated weight, measurements, access information and other practical details before confirming that we can safely undertake the work.

6. Starting services promptly and your cancellation rights

Funeral arrangements often need to begin soon after a death. Where you enter into a contract with us by telephone, online or away from our business premises, consumer law may give you a 14-day cancellation period.

If you ask us to begin providing services during that cancellation period, we may ask you to expressly confirm that request. If you then cancel after work has begun, you may be required to pay a reasonable amount for services already supplied up to the point of cancellation. If a service has been fully performed following your express request and the legal requirements for doing so have been met, your statutory cancellation right may end.

We will not use these terms to remove or restrict any cancellation right that the law gives you.

7. If you cancel arrangements

If you wish to cancel, please tell us as soon as possible by telephone or email.

Any amount retained or charged following cancellation will reflect services already provided and costs or losses reasonably incurred as a direct result of the cancellation. We will not impose a disproportionate cancellation charge or automatically retain money for services that have not been provided.

8. Times and dates

We will take reasonable care to progress arrangements properly and keep you informed. However, cremation dates, transfers and other timings can depend on third parties and legal or medical processes that BM does not control.

Examples include hospitals, medical examiners, coroners, registrars, crematoria and other authorities. Unless we have expressly agreed otherwise, an estimated date or time is not a guarantee.

9. Bariatric and complex deceased care

Specialist removals sometimes require additional staff, equipment, vehicles, access planning or assistance from other organisations. We assess each case before confirming what can safely be provided.

We cannot guarantee that every removal will be possible using BM resources alone. Where circumstances require additional assistance or specialist arrangements, we will discuss this with the person instructing us before proceeding wherever reasonably possible. Additional costs may apply and will be explained before they are agreed.

10. Third-party services

Some elements of funeral arrangements are provided or controlled by third parties, such as crematoria and public authorities. Where a third-party cost forms part of the arrangements, we will make the position clear and provide the price information required by law.

11. Our responsibility to you

We will provide our services with reasonable care and skill. Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability that cannot legally be excluded under consumer law.

We are not responsible for delays or failures caused by matters genuinely outside our reasonable control, but where a problem occurs we will take reasonable steps to explain the position and minimise disruption where we can.

14. Changes to these terms

We may update these terms from time to time. The terms applying to an arrangement are those provided or made available when the contract is agreed; we will not retrospectively change an agreed contract simply by updating this website page.

15. Governing law

These terms are governed by the laws of England and Wales. Nothing in this section removes any rights you may have as a consumer to bring proceedings in another UK jurisdiction where applicable law allows you to do so.
